Terms of Service

1. What PeakJuan is

PeakJuan is a software platform that helps online fitness coaches in the Philippines run their business — programs, clients, scheduling, logging. PeakJuan is not your trainer. Your coach designs your programs, gives advice, and is responsible for what they tell you. We provide the tool, not the coaching.

2. Who can use it

You must be at least 18 years old, or have a parent or guardian's consent if younger. Coaches must be the actual person running the coaching business — no using a friend's account as a stand-in.

3. Pricing

  • Coaches pay PeakJuan a monthly SaaS fee based on plan, sent manually via GCash to the founder. Plans are Basic ₱299/month, Pro ₱999/month, or Enterprise ₱2,499/month. Each plan caps how many clients, programs, packages, AI drafts, and custom exercises you can have at once — see your Billing page for exact limits. The plan and current paid-through date are visible under Settings → Billing.
  • Signups are admin-approved. After you sign up and send your first GCash payment, an admin verifies the transfer (usually within 24 hours) and unlocks your dashboard. Until then your account sits in a holding state and no fee is owed.
  • Plan changes happen on your Billing page — request a different plan, send the new GCash amount, and admin switches you over. Plan changes don't pro-rate; the existing paid-through date carries forward, and the next month bills at the new plan's price.
  • Clients pay their coach directly (GCash, Maya, bank transfer, cash — whatever the coach uses). PeakJuan does not handle, hold, or process those payments.
  • Refunds are governed by our Refund Policy. In short: a 7-day money-back window on your first SaaS payment, no partial-month refunds after that. Client → coach payments are refunded (or not) at the coach's discretion — PeakJuan doesn't process those.
  • Pricing may change with at least 30 days' notice by email. Existing paid-through dates honour the price you paid; the new price applies from your next renewal.

4. Acceptable use

You agree not to:

  • Use PeakJuan to harass, threaten, or defraud anyone.
  • Upload content you don't own the rights to, or that violates someone else's privacy.
  • Use the platform to give medical advice you're not qualified to give. Coaches: stay in your scope.
  • Try to access other coaches' or clients' data, reverse the platform's security, or run automated scrapers.
  • Resell or sublicense PeakJuan as your own product.

We can suspend or terminate accounts that violate these rules. Where possible we'll give a warning first; where the breach is serious (fraud, harassment, security), we may act immediately.

5. Your content

You own everything you create on PeakJuan — programs, exercises, logs, comments. By using PeakJuan you give us a limited licence to store and display that content as needed to run the service (e.g. so your coach can see your logs). We don't use your content to train AI models or sell to advertisers.

6. Coach & client relationship

The coaching contract is between you and your coach, not PeakJuan. If you have a dispute about the quality of coaching, refunds, or anything else with your coach, that's between the two of you. PeakJuan can provide audit trails on request (programs assigned, sessions logged, payments recorded) to help resolve disputes, but we don't adjudicate them.

7. Health & safety

Exercise carries risk. PeakJuan is a logging and program-management tool — it is not a substitute for medical advice. Consult a doctor before starting any new training program, especially if you have a pre-existing condition. You train at your own risk.

8. Availability

We aim for the app to be online when you need it, but we don't promise zero downtime. Maintenance and outages happen. If we lose data we haven't already backed up, our liability is limited (see §10).

9. Termination

You can delete your account anytime from Settings. We can terminate yours if you breach these terms or stop paying. After termination, we'll keep what we're legally required to keep (see Privacy notice) and delete the rest within 30 days.

10. Limitation of liability

To the maximum extent allowed by Philippine law, PeakJuan's total liability for any claim related to the service is capped at the lesser of ₱5,000 or what you paid us in the previous 12 months. We're not liable for indirect, incidental, or consequential damages.

Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited under Philippine law.

11. Governing law

These terms are governed by the laws of the Republic of the Philippines. Disputes go to the courts of Metro Manila.
